PollyClass terms

Part 1. Everyone
These clauses cover all three of our products.
1. Who we are
PollyClass is built and run by TYB Labs. TYB Labs is a brand of Lanier Web Development, based in Georgia, United States. Contact: daniel@tyb.ai. When these terms say “we” or “us”, that is who they mean. “You” means you, the person using the product.
2. The services
TYB Labs runs three products: TYB (Train Your Brain) for children, PollyStop for teen and adult learners, and PollyClass for tutors and small schools. Part 1 applies to all three. Each product then has its own schedule. The PollyClass one is Schedule C, at the bottom of this page.
3. Your account
You need an account to use PollyClass. Give us details that are true, keep your password to yourself, and tell us if someone else gets into your account. Anything done from your account counts as done by you. You must be 18 or over to open a tutor account.
4. Acceptable use
Use PollyClass to teach. Do not use it to break the law, to harass anyone, to upload material you have no right to upload, to attack or overload our servers, or to copy the service and sell it as your own. We can suspend or close an account that does any of that.
5. Your content and ours
What you write stays yours: your notes, your lesson plans, your student list. To run the service we need your permission to store that content, show it back to you, and send a learner the parts meant for them. That is the whole licence, and it ends when you delete the content or close your account. Our own material, meaning the software, the practice catalogue, the design and the name, stays ours.
6. AI is part of this, and it can be wrong
Parts of PollyClass are generated or checked by AI. It gets things wrong. Nothing it produces is professional advice of any kind. You are the teacher, so read what it says before you hand it to a student.
7. Availability
PollyClass is provided as is. We do not promise it will be up at any given moment, or that it will keep every feature it has today. We change things, and sometimes we remove them. If we remove something you rely on, we will tell you.
8. Prices
Prices, plans and free tiers can change at any time. A free plan is never guaranteed. We tell existing paying customers before a price change affects them.
9. Ending it
You can stop using PollyClass whenever you like, and you can delete your account from inside the product or by emailing us. We can close an account too, for a breach of these terms or if we stop running the service. Ask us to delete your data and we delete it.
10. Liability
Nothing here limits liability that the law says cannot be limited. Beyond that, if we owe you anything, the most we owe is what you paid us in the twelve months before the problem, or fifty euros if you paid us nothing. We are not liable for lost profits, lost students or lost data above that amount.
11. Governing law
These terms are governed by the laws of the State of Georgia, United States. Any dispute goes to the courts there.
12. Changes to these terms
We will change these terms from time to time. The date at the top says when they last changed. If you keep using PollyClass after that date, you accept the new version. For a change that matters, we will email you.
Schedule C. PollyClass
For tutors and small schools. This sits on top of Part 1.
Your students. You are responsible for having the right to add a student and to share their practice link with them. If a student is under 13, their parent has to agree before you add them.
Notes, practice and guests. Your notes about a student are yours and are private to you. A learner's practice is the learner's, and it moves with them if they connect their own account. Guest practice on an invite link is kept for 14 days and then deleted, unless the learner connects an account first, in which case what they practised moves across to them.
What we never do with it. We do not sell learner histories, and we do not turn them into templates or content for anyone else.
Your booking platform. PollyClass does not replace the platform you take bookings on, and it does not change that platform's rules. Following those rules is your job, not ours.
Founding tutors. The first ten tutors get PollyClass free while we build it together, for as long as they keep teaching with it and telling me what is wrong. After that, a free plan covers five active students and paid plans cover more. Prices can change at any time, and a free plan is never guaranteed. I will say so plainly before anything changes for you.
Price and availability. Prices, plans and free tiers can change at any time. A free plan is never guaranteed. We make no promise that PollyClass will be available at a given moment, and there is no service level attached to it.
